Chesterfield Co. Chancery notes - 1804-001 Taylor vs Turner
Samuel Taylor speaking for Amy his wife. Her late father was Benjamin Horner who had a comfortable estate both real and personal. He made his last will and testament 22 Aug 1777 and died shortly after. The excutor declined to serve and Matthew Turner was named. Ben. left slaves and stock to his wife Lucy and after her death it was left to her children. Lucy died 17 (left blank) and Matthew Turner took possession of all the property. Supposedly, one slave had been hired out for a lot of money. Matthew died 17 (left blank) intestate and his widow Patty Turner took possession of all the property. Amy had never been able to get a settlement even though she had requested it many times. She was due 1/6 part of Ben.'s estate with interest from the month of may 1783 until payment of at least 60 pounds is reached. May 1802
Answer of Martha Turner:
Ben. slaves had all run off to the British Army before her husband became ex. except for one and he had never been hired out. All the legatees except Amy settled with Matthew before he died. 9 Nov 1802
The will of Ben. Horner named his wife Lucy as his ex, but she declined. He left some property to his sons Abijah and Benjamin. After Lucy's death, her part was to be divided among all the children. Abijah sold one slave ten years ago. Amy was 16 years old at the time and is now 24. 12 nov 1803
Elizabeth Chalkley certified that Amy Taylor was born in April of 1778.
